    “QANTAS YOU” PROMOTION - TERMS AND CONDITIONS

    1. General
      1. You must be an Australian resident at least 18 years of age to sign up and participate in the Qantas “You” Promotion (Promotion). You can sign up and participate through the Promotion's website at qantas.com/you (Website) or by using the mobile phone application developed for the Promotion (Mobile App) (together, Hub). You can create a profile Hub and change your preferences to the extent permitted through the Hub, until 11.59pm (AEST) 19 July 2012. After that time, the Hub will be closed and no new profiles or changes to existing profiles can be made.
    2. Name On A Plane
      1. By selecting “I want my name on a Qantas plane” on the Hub, you consent to Qantas placing your full first name and last name on the side of a Qantas branded aircraft. You also consent to Qantas using images of its aircraft with your name on it in any Qantas advertising and marketing and promotional materials. Your consent does not oblige Qantas to place your name on its aircraft.
      2. Qantas proposes to use the following aircraft for the names:
        1. one of its Airbus A380 aircraft; and
        2. one of its Boeing B737-800 aircraft.
    3. Photo in Qantas marketing
      1. By uploading or otherwise nominating a photo to be associated with your profile on the Hub (Photo) and choosing “I want to be part of the Qantas ad campaign”, you grant to Qantas a non-exclusive, royalty-free, perpetual, irrevocable, world-wide, sub-licensable, transferable license to use that photo, both with your name and without your name, as set out in clause 5 and 6 without compensation.
      2. Unless you choose “Don't show me publicly”, you agree that the Photo or any part of it may be used, reproduced, modified, adapted, published and displayed without compensation, in any media, including any future media which does not yet exist, without restriction or liability for any purpose, including Qantas advertising and marketing and promotional materials.
      3. If you choose “Don't show me publicly”, you agree the Photo or any part of it may be used, reproduced, modified, adapted, published and displayed without compensation:
        1. In connection with the Hub when you are logged into the Hub; and
        2. in digital advertising viewed on a digital device when you are logged into your account through the Hub, which may be delivered through third party websites. For example, if you have logged into the Hub (and have not logged out), you might see yourself in digital web banner ads on other sites, for example news websites. These ads with your name and picture will only be presented for you to see on digital devices which you have used to log into the Hub and have not logged out, but are not available for the general public to view.
      4. By selecting “I want to be part of the Qantas ad campaign”, on the Hub, you also:
        1. agree not to assert any rights of integrity of authorship, rights of attribution of authorship, rights not to have authorship falsely attributed and rights of a similar nature that exist, or may come to exist, anywhere in the world (Moral Rights) that you may have in relation to the use of the Photo under the licence granted to Qantas or its sub-licensees or assignees;
        2. confirm any other parties who may have Moral Rights in connection with the Photo have:
          1. been provided a copy of these terms and conditions;
          2. read these terms and conditions and understood them;
          3. consented to the use of the Photo in accordance with these terms and conditions; and
          4. agreed not to assert those Moral Rights in relation to the use of the Photo by Qantas or its sub-licensees or assignees; and
        3. confirm that all persons appearing in the Photo (and the parents or guardians of minors appearing in the Photo) have:
          1. been provided a copy of these terms and conditions;
          2. read these terms and conditions and understood them; and
          3. consented to you uploading the Photo and for it to be used in accordance with these terms and conditions.
      5. You agree that Qantas is under no obligation to use the Photo in any of its advertising.
      6. Where Qantas does decide to use the Photo, you acknowledge and agree that you may not be able to make out the identity of anyone in the Photo in some cases due to the image being resized.
    4. Confirmation in relation to content you submit
      1. By uploading content through the Hub, you confirm that you have the right to submit that content and that doing so does not infringe any intellectual property rights and/or any other rights of any person or entity.
    5. Absolute discretion in relation to accepting and using content
      1. Qantas has the sole discretion and final decision in determining whether to accept or use any materials submitted for the purposes as outlined in these terms and conditions. All decisions relating to the selection and presentation of content submitted to the Hub will be determined by Qantas in its absolute discretion.
      2. Qantas reserves the right to take down and discontinue the use of any content you submit through the Hub at any time without warning in its absolute discretion.
    6. No Affiliation
      1. If Qantas accepts or uses the material you supply through the Hub, such acceptance or use does not constitute any endorsement, sponsorship, affiliation or any other relationship between you and Qantas.
    7. Limitation of liability
      1. To the extent permitted by law, Qantas, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses or costs arising out of your participation in the Promotion.
      2. To the extent it is not permissible at law to exclude liability in the manner contemplated in clause 14, liability is limited to the maximum extent allowable by law.
    8. Privacy
      1. The details that you provide through the Hub remain the property of Qantas. Your personal information will be handled in accordance with these terms and conditions and Qantas' Privacy Statement. See qantas.com/privacy for a copy of the Privacy Statement.

    Terms and Conditions - 2.5 million Qantas Frequent Flyer point give away

    1. Information on how to enter forms part of the terms and conditions of entry. Entry into the promotion is deemed acceptance of these terms and conditions. Headings in this document are included for ease reference, and do not form part of the agreement or affect interpretation in any way.
    2. The promoter is Qantas Airways Limited (ABN 16 009 661 901) of 203 Coward Street, Mascot, NSW 2020 (telephone number (02) 9691 3636) (Promoter or Qantas).
    3. Duration
    1. The promotion commences at 12.01am (AEST) on 29 June 2012 and closes at 11.59pm (AEST) on 19 July 2012 (Promotion Period).
    2. Eligibility to enter
    1. Entry is open only to Australian residents aged 18 years or older (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter and its related bodies corporate and registered travel companions of employees of the Promoter and its related bodies corporate.
    2. To claim the prize, Eligible Entrants must already be, or become, a member of the Qantas Frequent Flyer program. Membership is subject to the Qantas Frequent Flyer program Terms and Conditions (available at http://www.qantas.com.au/fflyer/dyn/program/terms). Refer clause 13 below for details.
    3. Entry into the promotion
    1. To enter, Eligible Entrants must during the Promotion Period:
      1. visit qantas.com/you (Website), or download the Qantas You Application (App) to a compatible mobile phone device. The App is provided free of charge, however the individual's standard download fees will apply. If the individual downloads the App, they must then follow the prompts to the entry page;
      2. create a profile on the Website or through the App by completing all required fields and agreeing to all terms and conditions; and
      3. select, and continue to have selected up until the time of the draw, one or more of the following options to participate in the Qantas You campaign and agreeing to the associated terms and conditions on the Website:
        1. The “Name on a Plane” element of the You campaign; or
        2. The element of the You campaign where permission is given to Qantas to use a photo uploaded by the profile owner.
    2. For the avoidance of doubt, while profile owners can choose to limit the extent to which Qantas may use a photo uploaded to the Website, all Eligible Entrants who upload a photo, irrespective of whether they choose to limit the extent to which Qantas may use the photo, are eligible to enter.
    3. Each Eligible Entrant will receive one (1) entry into the draw. Eligible Entrants may only enter once.
    4. The Promoter is not responsible for any technical malfunction of any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
    5. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who tampers with the entry process. Failure by the promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    6. Drawing of entries
    1. The draw will be computer-generated and will take place at 4pm (AEST) on 26 July 2012 at the offices of Mike Da Silva and Associates (Aust) Pty Ltd (ABN 50 003 894 022) (MDSA) at 15 Grosvenor Street, Neutral Bay, NSW 2089.
    2. The result of the draw is final and no correspondence will be entered into.
    3. The prize
    1. There will be 5 prizes. Each prize is 500,000 Qantas Frequent Flyer points (Prize).

      If a winner is not already a member of the Qantas Frequent Flyer Program, their prize will also include membership to the Qantas Frequent Flyer Program, normally valued at AU$82.50. To accept this part of the Prize, the winner must not already be a member of the Qantas Frequent Flyer program, and must agree to the Terms and Conditions of the Qantas Frequent Flyer program (available at http://www.qantas.com.au/fflyer/dyn/program/terms).

      The maximum notional value of each Prize is AU$20,924.00
    2. The maximum notional total value of all 5 Prizes is AU$104,620.00 (based on the values at the time of printing).
    3. The calculation of the maximum notional value of the Prizes is based on the value of Award travel which could be obtained by redeeming Qantas Frequent Flyer points through the Qantas Frequent Flyer program as at 7 June 2012. For example, 512,000 Qantas Frequent Flyer points could be redeemed for two return Business class Qantas Classic Award flights between Sydney and London Heathrow excluding applicable surcharges, fees and taxes. The estimate of value is provided for the purposes of this promotion only - the value of the Qantas Frequent Flyer points will vary depending on how they are redeemed by the winners through the Qantas Frequent Flyer program. The Promoter accepts no responsibility for any variation in the value of the prizes.
    4. The Prize points are awarded, and must be redeemed, in accordance with and subject to the terms and conditions of the Qantas Frequent Flyer program (http://www.qantas.com.au/fflyer/dyn/program/terms), the Qantas Frequent Flyer Store Terms of Use (https://store.qantas.com/termsofuse.a2), and any other terms and conditions disclosed at the time of redemption.
    5. The redemption of the Prize points is subject to the availability of Awards that may be obtained through the Qantas Frequent Flyer program. Qantas Frequent Flyer points may take up to 28 days to be credited to the winners' accounts.
    6. In the event a Prize is redeemed for Award travel, winners should be aware that the number of Award flight seats available is limited and availability depends on the flight, date, season and destination and some flights may not have any Award seats available. Prize winners will be responsible for all applicable surcharges, fees and taxes of Award travel or accommodation booked by redeeming their Prize. Surcharges, fees and taxes vary depending on departure points, routes, exchange rates and dates of travel and are subject to change without notice. Award travel is subject to the fare rules and the Conditions of Carriage of the relevant carrier. Compliance with immigration, health or other government requirements is the responsibility of prize winners.
    7. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter
    8. Notification of the winner
    1. The winners will be notified by email within 2 business days of the draw, and their names will be published in The Australian newspaper on 2 August 2012 Winner's details may be used on Facebook.com/Qantas.
    2. Qantas Frequent Flyer points will be awarded to the winners Qantas Frequent Flyer account within 28 days of the prize draw.
    3. Right of the Promoter to redraw
    1. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these promotion terms and conditions or forfeiting or not claiming a prize. For any prize that remains unclaimed on 9 November 2012, at the same time and place as stated in clause 11, subject to any written direction given under applicable law. Any winner(s) determined in accordance with this clause will by notified by email within 2 business days after the draw and their names will be published in The Australian newspaper on 16 November 2012
    2. Liability and variation of terms
    1. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. The Promoter reserves the right (subject to any applicable law) to cancel, terminate or modify or suspend this promotion.
    2. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this promotion, the promotion of this promotion or the use of any prize, including but not limited to any breach of these terms and conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
    3. The exclusion of liability in clause 24 does not apply to limit or exclude liability:
      1. for personal injury or death suffered or sustained in connection with the supply of goods or services which are supplied by the Promoter in the ordinary course of business. To remove doubt: third party goods or services, which other than in connection with this promotion, are in the normal course of business supplied by a third party unrelated to the Promotion Parties, are not supplied by the Promoter in the ordinary course of business; or
      2. to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
    4. Entry details and privacy
    1. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize. Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to third parties involved in the promotion and any applicable statutory authorities) and to conduct marketing activities and market research in accordance with the Qantas Frequent Flyer program terms and conditions available at qantas.com. Without limiting the foregoing, entrants' personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy Statement, a copy of which is available at www.qantas.com.au/travel/airlines/privacy/global/en.
    2. Taxation
    1. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize, including membership of the Qantas Frequent Flyer program (if applicable). Independent financial advice should be sought.

    Guidelines

    Thank you for helping us share the Spirit of Australians!

    Australians are a diverse lot, and we want you to be able to express yourself the way you want to - after all, this campaign is all about you! But remember, your content may be seen by lots of other people. That's why we've developed some content guidelines to help keep the campaign fun for everyone.

    Photos that have anyone else in them - We're asking you to upload a photo of yourself, since you're at the heart of everything that we do. However, we understand you might want to upload a photo that shows you with your nearest and dearest. In that case, we ask that you limit the photo to including you and just one other person, and that you make sure you get their OK (and, if they're under 18, their parent or guardian's permission) to submit the photo to be used in Qantas advertising.

    Keep it clean and respectful - Please consider the diverse backgrounds of all Australians, such as age, ethnicity, religion, and lifestyle. We know you're a sensible bunch and don't need to be told this, but here are some basic guidelines nonetheless:

    • Nothing offensive, socially irresponsible or illegal - don't submit anything which shows, depicts or refers to anything which could be offensive, such as provocative clothing or sexual acts, violent behavior or weapons. You should also avoid images showing alcohol consumption or illicit drug use.
    • Be respectful and don't discriminate - don't include anything defamatory or libelous, or which unlawfully discriminates against anyone for any reason, such as age, gender, race, sexual orientation, religion or anything else.
    • Dress to impress - make sure you and anyone else in your photo are dressed appropriately. This doesn't mean wearing your Sunday best, but rather being sensible about the clothing (and how much of it!) you're wearing in the photo you submit.
    • Include just you, not a message - don't include personal contact details (like phone numbers or email addresses), sales messages, or political statements, messages or symbols (such as flags).
    • Keep it real - please only upload a photo of you, and use your real name. We can't accept any joke or fake names or cartoon images. We also can't accept an image where it appears the account does not genuinely belong to that person, so don't imitate anyone or upload a photo of your favourite celebrity, actor, musician or sport person.
    • Speaking the same language - if your content contains a language other than English, we may contact you and ask you to supply a translation. Of course, the original text and the translation need to follow our guidelines.
    • Make sure all the content is yours - please make sure that what you upload doesn't infringe anyone else's rights, such as copyright, company logos or registered trademarks.

    Where do I find my Secret Code?

    Your Secret Code was emailed to you when you first registered. Can't find it? Don't worry just click on the "I'm already registered button" on qantas.com/you, enter your email address and we'll send you another email containing your code. Make sure to check your junk email box if you don't see it come through within an hour.

    Can I change or remove my picture from the campaign?

    Once you upload your photo, we will start using it according the selections you made on qantas.com/you. So that we can manage all the photos we receive, we ask you to confirm that you are happy with your photo when you upload it, and that you don't change it later. We also ask that you confirm you are happy for your photo to be used publicly, unless you select "Don't show me publicly", as it may not be possible for us to remove your photo from public media once we start using it.

    However, if you have any problems or concerns about your profile, you can email us at support@qantasyou.com, and we will handle requests on a case by case basis.

    How do I change my level of involvement in the campaign?

    Click on the "My Details" button and update your level of involvement. You will receive an email as confirmation of these changes. Please note you cannot unregister from "I want my name on a plane", "I want to be part of the Qantas ad campaign" or "I want to win Qantas Frequent Flyer points" once you have checked the box to register for these 3 items.

    How do I share my banner with my friends?

    When you registered, if you agreed that your photo could be used publicly (that is, you didn't select "Don't show me publicly"), then a personalised, shareable web page showing your photo has been created for you. Anyone can see this page, so you can share it with your friends. This will also allow them to see you in a Qantas banner and learn more about the campaign.

    Who can see my photo?

    When you registered with the campaign you were given the option of selecting "Don't show me publicly". If you selected that option, only you can see your photo, and it will only appear on your personalised webpage and in banners that are targeted only to a device you have used to log in to qantas.com/you (and not later logged out of the site on that device). If you didn't select that option, then we may use your photo in media that anyone can see, so your photo might appear in places such as on the background of webpages like qantas.com/you, in banners on selected external websites and in other media.

    How will my photo and name be used?

    Why can't I see my photo in the banners?

    Everything that is submitted to the Qantas campaign must be moderated. We aim to have everything approved within 24 hours, but it in some cases it might take longer, for example, if we have an unusually high number of profiles to review. If it's been over 24 hours and you still aren't seeing your image in banners check the following:

    Are you registered on the computer you're using?

    If not, go to qantas.com/you and enter your Secret Code

    Do you have your cookies turned-off?

    This campaign needs to use cookie information to link your picture to your computer. You will have to turn your cookies back on by following the instructions provided by your internet browser.

    Why wasn't my photo and/or name approved?

    What will you do with my information?

    Qantas respects your privacy. We will handle your personal information according to the selections you make on qantas.com/you, and in accordance with our Privacy Statement
